Taxpayer Lawsuit - Intisio/Senator Linthicum (OR) - File in Federal Court

Dennis Linthicum of Oregon and Antonio Intiso of the Siskiyou County Water Users Board and a resident of Yreka have filed a Complaint for Injunctive Relief in Federal Court in Medford, Oregon on June 8, 2023 naming as Defendants The Federal Energy Regulatory Commission, the State of Oregon and the State of California (CV-00834-AA). The suit which has been filed alleges that the named Defendants have specifically and willingly violated the National Wild and Scenic Rivers Act of 1968 (PL 901-542 as amended P.L. 117-286 December 27, 2022. The action further requests the Court to recognize the waters behind the reservoirs as waters under Public Trust and necessary for the proper operation of the Klamath River flows. Mr. Dennis Linthicum is a State Senator in Oregon from the Klamath County area.
The filed lawsuit requests further that the Court order a remand of the FERC decision to remove the hydro facilities and directs that an order that the Defendants and their agents restore any and all damages to existing infrastructure including but not limited to the restoration of the dams, their hydroelectric capabilities, fisheries and habitats impacted by the work conducted by the States and their Contractors and Agents. Further that the States and their Contractors and Agents be restrained from all current and future physical activities related to and or connected with the Removal of the Hydroelectric facilities. It would further request that the States and their Contractors and Agents refrain from any further current or future funding or any expenditure of funds beyond those associated with a “shutdown” of this project.
This lawsuit action has been long overdue to stop the continuing and irreversible harm to the environment, aquatic systems and the Klamath River itself as well as the citizens of the immediate area encompassing both sides of the California and Oregon border. The actions by FERC have been directed by outside sources with little concern expressed by its agents for the public in the affected areas and little to no regard for the inestimable damages that are forecast to result from the removal of these facilities. Very little effort was ever directed towards finding a more equitable and economical solution to the removal of these facilities.
Taxpayer Lawsuit - Update

We have had a little time to consider the Siskiyou County Superior Court Judge dismissing the Taxpayer Lawsuit by Tony Intiso. It was a surrealistic hiatus to a terrific effort to protect the Taxpayers of the State of California against unreasonable and deliberate attempt by politicians to conceal the facts in a 2014 Proposition entitled Water Storage and Clean Water Act, a 14 Billion dollar with interest taking from the wallets of California citizens to carry out special interest projects some having nothing to do with water storage or even with water. The issue in this case was several fold the first being the purposefully misleading Bond issue re water storage. The four Klamath Dams were never mentioned in the Bond Issue and in fact were concealed by using misleading language which referenced a then nonexistent agreement, the 2013 KHSA KBRA agreement.

He was well-regarded nationally, and his textbook, “Perkins on Criminal Law,” was widely used in leading law schools throughout the country. The students at my law school gave him a license plate that read “Suppose,” the word with which he began each class. His teaching method was to present a hypothetical situation to the class, beginning, of course, with the word, “Suppose.” He would then randomly call on and mercilessly grill his students about the legal principles presented in the hypothetical. Klamath Mitigation Fund Board is Subjective in Nature

I have recently had the opportunity to review the official letter from the Klamath Mitigation Fund which has been sent to selected property owners impacted by the proposed Klamath Hydro Dam Removal. These owners were selected based on criteria established independently by the Fund Administrators.
The criteria used to establish these affected properties were selected based on whether the properties had wells, potential side slope issues around the rim on Copco reservoir or are subject to potential flooding by being in the 100 year flood plain. The criteria established by the Mitigation Fund Board is subjective in nature.
Taxpayer Funded Lawsuit
Copco Lake is just one of the beautiful lakeside environments that will forever disappear as a result of removal of the Klamath Hydroelectric facilities. This area was originally part of a very ancient lake system formed behind massive lava dikes which crossed the Klamath River as a result of volcanic activity. The dike that formed Copco Lake was originally 135 feet high. Centuries of erosion left a “v“ shaped cut in the lava created by the River. That notch of solid basalt formed the perfect spot to erect the Copco I dam, the first of a series of electrical generating facilities developed by John C. Boyle one of the Nation’s top engineers and founder of Copco Power which is now part of the PacifiCorp power generating facilities. Warren Buffet is the owner of Pacific Power. John Boyle went on to construct three more hydro dams. It is these four dams that for more than two decades have been the goal of numerous environmental groups to destroy.
Anthony Intiso a resident of Yreka California and a member of the Siskiyou Water Users Association Board acting as his own attorney has filed a Taxpayer lawsuit against the State of California to stop the funding by the State of California using taxpayer dollars originally voted for Improving water quality and water storage (Prop One). These funds had a specific requirement not to be used in projects which had an adverse impact on a Wild and Scenic River such as the Klamath River. The EIR/EIS by the Federal Energy and Regulatory Committee (FERC) states categorically that the removal of the hydro facilities will have an adverse impact on the River quality, the fish life, wildlife and birdlife. The removal will flush 20-30 million cubic yards of sediment downstream. Despite this the FERC argues that in the long run it will survive and improve. There are no studies to support this contention.
Citizens in Siskiyou County and the surrounding counties as well as the Southern Oregon Counties fronting on the Klamath including the agricultural communities in the area are opposed to dam removal by 80%. In a General Election 80% of the voters in Siskiyou County voted to retain the dams. Despite this the environmental groups and Governor Newsom have continued spending taxpayer funds and using their political leverage to push removal of these facilities to the detriment of the local communities. The fact is that rural communities are under attack by the leftist governments such as California and Oregon. They are committed to destroying these rural areas.

The Siskiyou County Republican Central Committee is pleased to announce that at the recent California CAGOP Convention in Sacramento attended by nearly 1400 delegates a Resolution was adopted by the Board of Directors announcing their support for the Citizens of Northern California and Southern Oregon who are trying to retain and preserve the historic Klamath Hydroelectric Facilities and the lakes behind them. These actions by Governor Newsom are purposefully aggravating California's water situation and increasing energy costs at this difficult time in history and importantly are depriving the Citizens of their voice in this important matter.

WHERE AS, the Citizens of Northern California and Southern Oregon are making efforts to retain the historic Klamath Hydroelectric Facilities and the lakes behind them.
WHERE AS, the actions of Governor Gavin Newsom and his administration to attempt to remove these hydroelectric facilities and harm rural California families and economies that rely on these vital structures.
WHERE AS, these hydroelectric facilities provide low cost, clean hydro energy, provide habitat for many threatened and endangered species including fish and other aquatic mammals; birds using the Pacific Flyway, provide recreational opportunities, water storage and flood protection. In addition, the lakes behind the hydro facilities which have been in existence for more than one hundred years provide an easily accessible source of water for firefighting which has proved invaluable in the recent years.
WHERE AS, the Citizens in Northern California and Southern Oregon have demonstrated through polls and a general election that they overwhelmingly support retention of these facilities.
WHERE AS, Governor Newsom has continued to exhibit a callous disregard for the Citizens in that area as well as for Californians in general by spending billions in taxpayer funds in a time of energy shortages and water crises to destroy these facilities sending 14 Million acre feet of water out to the Pacific Ocean without providing any beneficial use to the communities most directly affected. Their destruction will result in 15 to 30 million cubic yards of sediment including toxic mercury, filling the Klamath River, killing fisheries and ecosystems.
THEREFORE BE IT RESOLVED that the CAGOP condemns the actions of Governor Gavin Newsom for purposefully making California's water situation worse, increasing energy costs, and depriving the Citizens of their voice in this important local matter.

Klamath Irrigation District (District) is in opposition to HB 2647 as amended. Klamath Irrigation District is a special government district operated under Oregon Revised Statute 545. The District is responsible for distributing the naturally nutrient rich waters of the Klamath Basin to agricultural farm land for beneficial use.
HB 2647 significantly increases government costs to monitor, report, and reduce known natural sources of phosphorus, sulfur, and nitrogen in the volcanic areas which are rich in nutrients which enable and promote algae blooms.

Legitimate and important questions have been raised that haven’t been answered or adequately addressed by PacifiCorp, the Klamath River Renewal Corporation, the governors of the states of Oregon and California, or the Secretary of the US Department of the Interior. And they are not adequately addressed in the Environmental Impact Statement recently approved by the Federal Energy Regulatory Commission (FERC). All appear to be hell-bent to get this done, regardless of the potentially disastrous consequences. A political bulldozer.

Last week California Governor Gavin Newsom announced final approval of a plan to remove four dams on the Klamath River in Northern California, along with Oregon Governor Kate Brown, U.S. Secretary of the Interior Deb Haaland, Congressman Jared Huffman and leaders of the Yurok and Karuk tribes. Newsom refers to the dam removal project as “transformative” and says “it will revitalize nearly 400 miles of the Klamath River and tributaries.”

YREKA, CALIFORNIA, December 12, 2022 - Siskiyou County Water Users Association (SCWUA) announces filing of a Summons and Complaint in the Superior Court of California for Taxpayer Complaint for Injunctive and Declaratory Relief by Anthony Intiso. This action was filed against Defendant Wade Crowfoot Secretary of Natural Resources Agency and as an Individual person in connection with the funding operations for the proposed removal of the Klamath River Dam complex in Northern California. This action was filed as Case Number 22CV00609.
The case was filed Pro Se by Mr. Anthony Intiso, a member of the Board of Directors of SCWUA, to enjoin Defendant Wade Crowfoot, Secretary of Natural Resources from expending taxpayer funds in the amount of $250,000,000 (TWO HUNDRED FIFTY MILLION DOLLARS) for the removal of the Klamath River project hydroelectric facilities. Mr. Intiso alleges that the continued disbursement of funds to Klamath River Restoration Corporation should be halted as it was specifically outlawed by the Bond language contained in the Bond Act of 2014 labeled the “Water Quality Supply and Infrastructure Improvement Act of 2014”.
The Klamath River is part of the Federal Wild and Scenic River system identified and approved by Congress and is further so identified in the State of California parallel act. The Bond Act of 2014 specifically states in Chapter 4, Section 79711 e that the funds from the Act cannot be and will not be used for any project that could have an adverse effect on a Wild and Scenic River. The recent FERC approved EIR references numerous times that the removal of the hydroelectric facilities will create and have adverse effect on the Klamath River including but not limited to sediment and proposed in channel modifications to “create” a free flowing and volitional fish passageway. Mr. Intiso argues that this is in direct opposition to the language of the Act which was clear that funds not be used in projects that would impact a Wild and Scenic River.
In the Prayer for Relief and request for judgement Mr. Intiso asks the Court to find that Defendant Wade Crowfoot is violating the provisions of the Act and that such expenditures are illegal and therefore Mr. Crowfoot is acting outside his official authorization and instead acting as an individual. He requests that if the Court finds this to be so then Mr. Crowfoot should personally repay the illegally expended funds.
Mr. Intiso requests the Court to issue an immediate injunction restraining and preventing further expenditure of funds until the Court has rendered its opinion on the substance and request for relief.

Richard Marshall, President of the Siskiyou County Water Users Association (SCWUA) announced today that the Association has filed a Motion to Intervene, on Friday with the Federal Energy Regulatory Commission (FERC) in the matter of the Application for License Amendment and Partial Transfer of PacifiCorp and the Klamath River Renewal Corporation of the Klamath Hydroelectric Project. SCWUA has filed the request to deny the transfer which is proposed to the FERC in the Project 2082-062.

Plans to remove four privately owned, obsolete power dams on the Klamath River advance with California taxpayers putting up more than half the cost.
Decades of political conflict over the fate of four dams on the Klamath River reached a turning point last week with a multi-party, two-state “memorandum of understanding” to remove them in hopes of restoring salmon runs. California Gov. Gavin Newsom, Oregon Gov. Kate Brown, heads of two Indian tribes that depend on the river for sustenance, and an executive of Warren Buffett’s PacificCorp that owns the dams announced agreement on a $450 million removal project.
